The ‘civil’ Traffic Ticket – “it Ain’t No Crime” …at Least That’s What the State Claims!

“For sixty years the U.S. Supreme Court avoided trekking through the constitutional minefield accumulated around the long standing practice of police stopping and temporarily seizing people at ‘civil’ traffic stops.”

It’s a nice day and you are traveling down the road in your automobile listening to one of your favorite tunes playing on your car stereo when, a frenzied display of psychotropic red and blue pulsating lights appear suddenly in your rearview mirror. It’s a traffic cop! Like a warring bird of prey, he has swooped down upon you at lightning speed from out of nowhere and now he has you hopelessly locked firmly in his clutches.

Millions of Americans each year, traveling upon our nation’s highways and streets, share in a similar unpleasant experience of getting a traffic ticket. In most states, minor traffic offenses are legally classified as infractions. Infractions are considered legally to be ‘petty offenses’ of the law and not a crime. The commission of an infraction is classified as a non-criminal act and, therefore, the infraction is a ‘civil’ breach of the law.

There is little civil about the experience of being chased down like a common criminal by an armed police officer and handed a civil traffic ticket. Most people find the experience to be very unnerving, if not downright frightening. The civil traffic stop is made infinitely more tyrannous in light of the fact that the victim of the cop’s assault committed no crime.

The Fourth Amendment was designed to protect us against unreasonable search and seizures, requiring police to first have probable cause. Although probable cause was not defined by the Fourth Amendment, the Supreme Court has long held that probable cause must include a criminal act to warrant seizure, or arrest. In Terry v. Ohio, 392 U.S. 1 (1968) the U.S. Supreme Court held that police may briefly detain a person if they have a reasonable suspicion that the person has committed, is committing, or is about to commit a crime.

Being that the Supreme Court’s litmus test for probable cause has historically required the element of a crime to be associate with reasonable cause for a seizure, how then is it possible that a traffic stop (seizure) for a non criminal civil infraction not to be a violation of the Fourth Amendment?

In 1967, the Supreme Court cracked open the door to provide legal sanction to what police officers were already doing around the country in violating the Fourth Amendment (performing traffic stop seizures for non-criminal civil infractions). In Delaware v. Prouse, 440, U.S. 648 (1967) the Supreme Court ruled, “The permissibility of a particular law enforcement practice is judged by balancing its intrusion on the individual’s Fourth Amendment interests against its promotion of legitimate governmental interests.” [writer emphases added]

For over sixty years the U.S. Supreme Court avoided trekking through the constitutional minefield accumulated around the long standing practice of police stopping and temporarily seizing people at ‘civil’ traffic stops. Civil traffic stops (seizures) were unquestionably at odds with people’s Fourth Amendment protection against unreasonable seizures. The Supreme Court’s refusal to take the lead on the constitutional issue of the civil traffic stop left the state courts twisting in the wind of tyrannous constitutional construction and clamoring for a clear constitutional path they could take to safely traverse around the Fourth Amendment roadblock regarding the civil traffic stop and seizure.

The state courts have long and desperately sought the U.S. Supreme Court’s assistance in constitutionally ‘legitimizing’ (tweaking the Constitution) the six decade practice by police officers of seizing people for civil traffic offenses. The state courts had no way of neatly disposing of the highly problematic constitutional requirement that the U.S. Supreme Court had saddled them with. The U.S. Supreme Court had ruled that probable cause for a temporary seizure required a crime and the civil traffic stop was not a crime.

In 1996 the U.S. Supreme Court in the case of Whren v. United States, 517 U.S. 806 addressed head on the question of whether or not the civil traffic stop (seizure) violates a person’s Fourth Amendment rights. Acquiescing to the state courts’ demands, the Court provided the state courts with exactly what they had long sought, ruling; “As a general matter, the decision to stop an automobile is reasonable where the police have probable cause to believe that a traffic violation has occurred.” [writer emphases added]

Politicians are well known for their talent to spin things. ‘Spinning’ is the ability to make things appear to be something that they are not. However, this talent is not limited only to politicians. Supreme Court justices are also very practiced in the art of spinning. Justices of the Supreme Court are lawyers, and lawyers practice a form of spinning known as ‘legal word art’. This form of spinning is created by transforming common words into technical legal jargon with hidden meanings.

The Supreme Court in the Whren case applied a hefty dose of good ol’ spin doctoring, as the politicians like to say, to make it appear as if the civil traffic stop was not an assault on our Fourth Amendment protection against unreasonable seizure. The Court in Whren capitalized on the use of one tiny, common, ordinary word – a word everyone uses and believes that they know the meaning of – ‘traffic.’

Traffic; the flow of vehicles and pedestrians along public right of ways. True? Yes, quite true when the word traffic is used in its ordinary sense, but not true when the word traffic is used in its legal sense. The word traffic used in its legal sense means an activity involving commerce — transportation of goods and people for profit as revealed in the following definition for the word ‘commerce’ under U.S. Code, Title 42, 21, VI, § 2000e (g). The term “commerce” means trade, traffic, commerce, transportation, transmission…” [writer emphases added]

A little more than a century ago, America had less tyrannous courts. The following 1898 Illinois Supreme Court ruling regarding the licensing of motorized methods of private transport of people not engaged in traffic is great proof of how at least one state supreme court followed the Constitution back then.

“The license is designed to operate upon those who hold themselves out as common carriers, and a license may be exacted from such as a proper exercise of police power; but no reason exists why it should be applied to the owners of private vehicles, used for their individual use exclusively, in their own business, or for their own pleasure, as a means of locomotion.” City of Chicago v. Collins et al., Supreme Court of Illinois. 175 Ill. 445, 51 N.E. 907 (Oct. 24, 1898).

The Illinois Supreme Court in 1898 held firm to the constitutional fact that the states have the power to regulate, license, and tax only those persons engaged in the activity of commerce related to the transport of people and goods upon the public right of ways.

Technically, the Supreme Court did not assail our Fourth Amendment protection against unreasonable seizure. Stopping and temporarily seizing a person engaged in traffic (an activity in commerce) does not per se violate their constitutional rights under the Fourth Amendment. The constitution grants states the right to regulate profit making activities in commerce upon the public right of ways.

In a realest or truest sense, the Supreme Court walloped our Fourth Amendment rights smack between the eyes with Whren (which was the Court’s intention from the get go). The states had long been pressuring the Supreme Court for a ruling such as this. They desperately needed to justify sixty plus years of doing what is not justifiable – their long practice of seizing people not in engaged in commerce at so called civil traffic stops.

Had Whren raised the issue about his not being engaged in commerce and a regulated activity, at the time of his trial, then in all likelihood the Supreme Court would have passed on hearing his case. The Court would have just waited patiently for another case to come along possessing the elements necessary to rule in the same manner as the Court had done in the Whren case.

Traffic boils down to money, power, and control. Traffic tickets are a multi-billion dollar bonanza for state and local governments. Profit making activities allows the government to regulate, license, and tax people under the constitution. The state traps people into traffic in much the same manner as it does regarding the Income Tax – the government just pretends that we all are engaged in a profit making activity.

The Supreme Court acted on the pretense that Whren was engaged in a profit making activity upon the public right of way and therefore, the state had the power to regulate his activity (driving or being in commerce). The police have the right to regulate traffic and, therefore, can constitutionally temporarily seize a person engaged in commerce to issue them a traffic ticket for a civil breach of the state’s driver’s license compact.

The state’s so called driver’s license compact is written for those engaged in commerce. However this fact is cleverly disguised and hidden from people by the lawyers who write the laws using the “spin doctoring” or ‘legal word art.’

Your possessing a driver’s license is not proof or evidence that you are engaged in traffic. You can have a driver’s license and your car can be registered and this does not prevent you from lawfully traveling in your private constitutionally unregulated capacity upon the public right of ways. It’s the activity of engaging in commerce that grants the states the right to regulate traffic and nothing in the Constitution grants the states the right to regulate the people’s right to travel. The right to travel is not and cannot be made a regulated activity. Therefore, the temporary seizure by a police officer at the time of a traffic stop is unquestionably unconstitutional.

How to Create Your Own Perpetual Traffic Machine

The Internet is such an unknown commodity anything is possible. One of the most intriguing questions concerns the idea of a perpetual traffic machine. Create a website and design a system of automatic programs (both interior and exterior) that delivers content and backlinks to a site that updates itself automatically and keeps growing without any help from the creator. In the process you build a flow of traffic that never stops, even if the site is abandoned or not touched for a couple of years or never again.

Is such a perpetual traffic system really possible?

Before you conjure up pictures of HAL and creepy talking computers in distant space… realize that question may carry more weight than it would seem at first glance. But is it like its predecessor, the perpetual motion machine – just more an illusion than actual fact?

For curiosity’s sake if for nothing else, the idea of a perpetual traffic machine does require further investigation. Such a system would have special interest for millions of webmasters whose main task is acquiring traffic for their sites, not to mention the potential for monetary gain a PTM (rhymes with ATM) would produce. Some credence was given to the idea recently when Tinu Abayomi-Paul, a well-known online free traffic expert, produced with the help of Marlon Sanders an info-product entitled “The Evergreen Traffic Machine.”

Tinu’s story is very interesting. Tinu had built up a whole array of sites and optimized them successfully for countless keywords in all the major search engines. She had built up a steady flow of traffic, resulting in thousands of visitors “a day” to her sites. This in itself is not that extraordinary, but that’s not the full story.

Because of a personal illness she abandoned or left alone most of her sites for over a year or more – only to discover the traffic systems she had put into place didn’t just dry up, they still kept producing tons of traffic even though the sites weren’t being updated.

The traffic was still coming. The traffic was still fresh.

Tinu basically built her perpetual traffic system around three major areas: High Profile Article Marketing, Exact Keyword Focus and Blogging/RSS Feeds. Tinu’s system proves you can create a traffic system for a year or two, but the real question is will it still produce traffic five years from now? Fifty years from now? How about a hundred years?

The real question: how long will such a system work without fresh input of unique content like the viral articles and blog posts now feeding it? This question is even more tantalizing when you consider it is now possible to create fresh content on your sites with RSS feeds, blog comments and user contributed content.

What’s more intriguing is the fact that all aspects of a website can be automated, including payment for all renewals: domain, hosting, autoresponders… as well as the collection of revenues such as affiliate commissions and advertising fees.

Are we at the stage where the Internet will be filled with these automated human-less web sites drawing traffic/visitors and slowly building and expanding on their own for eternity? Many cynics would argue this is already the case with the majority of sites on the web.

In case you like that idea and want to fully embrace this brave new automated perpetual Internet, here are a few tips to create your own eternal traffic machine:

1. Build lists and pre-load your AR system with follow-up messages to keep visitors coming back to your site. You can rotate these messages and ask your subscribers to opt-in to different lists on related subject areas. Always ask your readers to recommend your content to others.

2. Use social bookmark software or links so that your visitors can easily bookmark your content which brings in both new links and new traffic. Simple programs like the one offered by Addthis.com will get your visitors building your backlinks for you, bringing in fresh visitors who in turn will also bookmark your content.

3. Write viral articles, reports and ebooks that have your backlinks in the resource boxes. Likewise, viral software programs can help bring a constant flow of traffic to your site. If your content is of a high quality and your themes universal… new sites will pick up your content and build your backlinks, creating fresh traffic. The search engines will also index these new links and your rankings will increase, bringing in more traffic.

4. Use blogging and RSS feeds to get your content out there. You can also use these RSS feeds to bring in new fresh content to your site. Creating new content will be your main obstacle to creating perpetual traffic… you can get new content from feeds but will it be unique? Comments in your blogs could bring in unique content but if you’re not monitoring them, you must have solid software in place to fight against spam.

5. Have “Tell a Friend” forms on all your content. This will bring new traffic to your site, which can be self-refreshing as new people discover your content.

6. Encourage user generated content such as articles, comments, posts… you can even have a community monitoring system where your site’s members monitor this new content.

7. Form JV alliances with webmasters in your related field. Do co-registration so that you help build each other’s lists and traffic.

8. Likewise, if you have products to sell, create an affiliate program to get your affiliates to build your traffic for you. Affiliates are an excellent source of permanent traffic.

9. Automate all aspects of the running and managing of your website. Set up automatic payments for your AR system, hosting, domain renewal, PPC payments… thru PayPal or credit card. Likewise, receive affiliate commissions thru PayPal or direct deposit. Many advertising programs like Google Adsense offer direct deposit.

10. PPC Traffic – While we have mainly looked at free traffic systems, don’t forget creating a PTM is relatively easy with Pay Per Click advertising if you know what you’re doing. Target less competitive keywords to keep your costs down, tie this traffic into a good squeeze page for feeding your AR system with leads and have a good landing page that converts. You can create a system that delivers perpetual traffic and pays for itself from your affiliate commissions and advertising fees.

In summary, the argument for the existence of the PTM mainly relies upon the quality of your content or site. Is it unique enough to draw in new visitors? Does your topic have universal appeal that people never tire of? Does it solve or offer advice on a common human problem? Will or does it have a viral “word of mouth” element to it?

As we move to a more and more automated world, all the automated programs and hardware are in place for the creation of such perpetual traffic machines.

Computers, autoresponders, content management software, RSS feeds, viral marketing, direct deposit, automatic payments… and the list goes on. If we haven’t already created the perpetual traffic machine – we are getting tangibly close to doing just that.

Traffic Generation Tips To Explode Your Business

Traffic generation is the key to an online business success. No Traffic means No Business. You could have the best product, best sales letter in the world but if no one knows about it sales are going to be very low. Bottom line is getting traffic is crucial.

Traffic generation are the marketing techniques you apply to generating leads for your business and building a massive database which overtime will convert into customers. There are off line and online marketing methods.

For the purpose of this article I will cover predominantly online methods for you to get started but there are hundreds of different techniques you can use to get traffic to your business.

Traffic generation or lead generation for any business tyically requires a cost which is significantly higher cost than getting a customer to buy more products from you, therefore, it is very important to great conversion strategies and retention strategies in place once your business is up and running so you can improve your bottom line.

Today technology is advanced and to many people often a daunting task and for that very reason may stop people from investing into Internet Marketing strategies to help increase sales. If this is the case I would do one of two things. First, I would look to employ someone who specialises in traffic generation. There are people out there today who do this as a full time job. Pay the professionals. Second, I would look to invest some time and money into self education. Alternatively, look towards a mentor or a coach to help you achieve your desired outcome.

Traffic Generation Techniques

There are 100s of ways to generate traffic to your site ranging from offline to online traffic. Some techniques will have a significant cost, others will be FREE, for example, saying to someone at a party here is my business card go and have a look at my site. So open your mind, you may focus on a couple of different methods to start with and then branch out with some more advanced strategies later after you have developed your skills and mastered some of the traffic generation techniques.

Here are a few to kick start your business

Low to No Cost Methods

1. Tell a friend

As mentioned above you surely have a few friends that may be interested. You obviously have a friendship so you may not want to do a hard sell but why dont you just say, I have just joined this program online, it is a way I am looking at making a bit of extra cash if you want to have a look here is the address. Then they can make there mind up yourself. You will probably already have a few people in mind that would most likely jump at the concept.

2. E-Mail

You can send out a group e-mail to all your friends, if they are not interested kindly just ask them to send it on to people that may be interested. If you are advanced you could look into setting up an auto responder. The system has an auto responder working on your behalf to convert your leads, however, we have personally introduced our own auto responder to improve our relationship with our leads to convert to m1 consultants or upgrading consultants from m1 to m3. The other value of our auto responder is we are going to provide valuable e-mails to help all consultants in our team build their business.

3. Social Networking Groups

Groups such as myspace, facebook, youtube are great ways you can sell your product. There are groups on social networking sites that you can join yourself; you can set up a page and just network with people. I joined facebook and had a number of people I had not spoken to in years find me, some of them were actually people that are interested in what I am doing now and have invested money into some business mentoring, and purchased products. You will be surprised at the power of these mediums to generate traffic to your site.

4. Buy a Baby Name Book

This is out there thinking but by going through the names in the book it my spark a thought of someone you know with that name that you can contact and direct them to your site. While not a traditional method, it is cost effective and certainly a way to spark your memory on someones name and then contact them and try to get them to look at your site.

5. Blogging

Blogging is probably a more advanced strategy but it can be free by joining wordpress.com, or blogger.com and setting up a blog post which is effectively an online diary.

This certainly helps drive traffic to your site, it helps build rapport with your customers and creates a connection. Blogging also helps with search engine optimisation.

Some other advanced blogging strategies including

b)Submit your blog to directories. Directories such as Digg.com and Decicious.com have heaps of traffic.

6. Search Engine Optimisation (SEO)

SEO is the process of ranking your website in the free part of Google or other search engines. Google looks at the code of each website and ranks your site based on a number of features. It is obviously important to get as close to the top as possible because that increases your chances of making a sale or having people click onto your website. The first thing Google looks at is the title tag at the top of the page and the last thing is the bottom right hand of the page. It is known as the first and last principle. You want to have the same keyword at the top and bottom of the page. Some other key features that help with page rank include page title, meta description tag, meta key word tag. This is a simplified look at SEO and can be effected by a number of off page strategies also but if you at least do the basics you will improve your chances of generating some more traffic.

7. Google Ad Words

Google Ad Words is effectively paying for your leads. You put an ad up and when people click on the ad it will cost you money. It can be costly if you do not have any idea on what you are doing. My advice is only start exploring this avenue once you are either generating sales and have some cash to invest in marketing strategies or are very savvy in this area. In saying all that it is a great way to build a database and make some sales once you understand how to do it properly.

8. Zango

Very similar to setting up a Google ad words campaign. It is an online media company that gives people free access to games, videos and other online entertainment. In return for the free content they agree to view targeted advertising.

9 eBay

There are over 270 million people on eBay holding a credit card in their hands. Therefore, for any business in the world I would suggest if you want to get an online presence and do not understand Internet Marketing have an eBay business and set up your store. You can not directly direct traffic from eBay however there are a number of people that creatively send traffic from their eBay business to their Internet business.

10. Google Ad Sense

You can advertise on other peoples websites and blogs and it is a pay per click method. Internet Marketers advertise their products on their own websites because it increases sales significantly.

11. Articles

You can submit articles to article submission websites. Great examples of article submission websites include articlemarketer.com and you can direct the traffic to a specific site. With article submission the subject line is crucial. Like Google adwords and Zango you need to use great key words in your subject line that you think people would put in the search section of Google to find your product. Another important thing to understand with articles is that you only want to advertise at the end of the article and in particular in the authors resource box. Have great content in the article and then they will want to buy your product at the end of the article and then from the authors resource box send them to a forced opt-in page. On the forced opt in offer a free report, newsletter or some form of free gift and then once they have opted into your page have a sales letter with the product. In this instance you drive your traffic to your site and once people opt into your page you will have an auto responder set up to convert your leads.

12. Create products to give away

Another traffic generation technique is to create products. You could write an eBook, create a video or audio and with your product you could promote throughout the product. One method is create a product and give the resale rights to your product. You advertise at the start of the product and the end of the product and maybe with a footer at the bottom of the page. You give people the rights to sell your eBook and keep all the money and the trade off is you can get traffic and branding. That is a win win situation.

13. Hiring someone to drive the traffic

If you are not technically minded, or are not interested in self-education I would strongly recommend you pay someone to drive the traffic to the site. There are plenty of people you can pay to do it for you. Obviously, you would want to budget for this and like any business you need to have a budget for marketing, your budget is set up for outsourcing traffic generation.

14. Affiliate marketing

Save the best for last

Regarded as the greatest way to market your product is by affiliate marketing and giving people commissions for making a sale on your behalf.
